The Special Counsel for Immigration Related Unfair Employment Practices (the "Special Counsel") brings this action to enforce 8 U.S.C. § 1324b. 2. This suit arises out of Respondent's refusal to employ I(b) (6) his citizenship status and refusal to employ Mr. (b) (6) and Mr. ecause of (b) (6) fter rejecting documents that on their face reasonably appeared to be genuine and requesting more or different documents than required under 8 U.S.C. § 1324a. JURISDICTION 3. Jurisdiction of the Office of the Chief Administrative Hearing Officer is invoked pursuant to 8 U.S.C. § 1324b(e). PARTIES 4. Pursuant to 8 U.S.C. § 1324b(c)(2) and (d)(1), the Special Counsel is charged with investigating charges and prosecuting complaints alleging immigrationrelated unfair employment practices. 5. The charging party, (b) (6) is and was at all relevant times a work- authorized non-U.S. citizen from Mexico. 6. Respondent, Covenant Transport, Inc., is headquartered in Chattanooga, Tennessee, and operates facilities throughout the United States. 7. Respondent employed more than three employees on the dates of the alleged immigration-related unfair employment practices described below. STATEMENT OF FACTS 8. The immigration-related unfair employment practices described below occurred in Chattanooga, Tennessee. 9. On December 22, 2001, Mr. (b) (6) pplied for a position as a tractor trailer driver with Respondent. 10. Respondent then instructed Mr. (b) (6) o provide a copy of his passport, driving school diploma, Social Security card, INS work authorization, and job references to the company to establish his employment eligibility. Mr. (b) (6) xed documentation to Respondent, including a copy of his unexpired INS Form I688B (employment authorization document). 2 11. On or before January 15, 2002, Mr. (b) (6) eceived a notice from Respondent stating that he had been conditionally approved to attend new-hire orientation. 12. (b) (6) On or about January 15, 2002, Mr. alled Respondent to make arrangements to attend orientation. At that time, Respondent informed Mr. (b) (6) that it could not hire him because he did not possess a "green card." 13. (b) (6) In January 2002, Mr. did not possess an Immigration and Naturalization Service Form 1-551, commonly referred to as a "green card." He possessed other documentation establishing his employment eligibility for purposes of satisfying the requirements of 8 U.S.C. § 1324a. 14. Mr (b) (6) ontacted the Office of Special Counsel and obtained information about his right to work in the United States. He faxed that information to the Respondent on or about January 18, 2002. 15. (b) (6) eceived a telephone call from Ms. On or about January 22, 2002, Mr. (b) (6) Human Resource Manager for Respondent. Ms. (b) (6) nformed Mr.(b) (6) that the company made a mistake and that he should again fax his documents to the company. Mr. (b) (6) id as requested but was never again contacted by Respondent. 16. If Respondent had accepted Mr. (b) (6) mployment eligibility documentation, he could have attend a new-hire orientation in January, 2002. 17. Respondent's refusal to hire Mr. (b) (6)aused him to suffer a loss of earnings. 18. Mr.(b) (6)filed a charge alleging unfair employment practices with the Office of Special Counsel on February 14, 2002. 3 19. On June 14, 2002, the Office of Special Counsel notified Mr. (b) (6) y certified letter that he had the right to file his own complaint before an administrative law judge. 20. (b) (6) In January 2002, applied for a position as a tractor trailer driver with Respondent. 21. Mr(b) (6) is an asylee, and was at all times relevant to this matter. 22. Mr (b) (6) received a notice from Respondent informing him that he had been conditionally approved to attend new-hire orientation. 23. Respondent supplied Mr.(b) (6)with a one-way bus ticket from his residence in Georgia to Chattanooga, Tennessee. 24. Mr. (b) (6) called Respondent to confirm the orientation, he was told to bring his Social Security card, driver's license, job references and work permit. 25. On or about January 22, 2002, Mr. (b) (6) attended a three-day new hire orientation for Respondent. On the second day of orientation, January 23, 2002, Mr.(b) (6) ompleted an INS Form 1-9 and was asked to present his work authorization. 26. To establish employment eligibility, Mr. (b) (6)presented his Employment Authorization Document (INS form 1-766), his restricted Social Security card, his driver's license, and his INS Form 1-94 indicating that he was an asylee. 27. On January 23, 2002, respondent again asked Mr. 1-94 and Social Security card. 4 (b) (6)o present his INS Form 28. Mr(b) (6) was then informed that he had been disqualified from employment because he was not U.S. citizen or lawful permanent resident and did not have a green card. 29. Mr(b) (6) re-applied for work with Respondent in July 2002. He was asked to attend orientation, and asked to present his INS work authorization document. 30. In July 2002, Mr.(b) (6)presented his restricted Social Security card, Employment Authorization Document ( 1-766), INS Form 1-94 indicating that he is an asylee, Georgia driver's license, and a Refugee Travel Document (INS Form 1-571). 31. Mr (b) (6)was hired by Respondent on July 19, 2002. 32. Respondent's refusal to hire Mr. (b) (6) n January 23, 2002, caused Mr. (b) (6) economic harm. COUNT I CITIZENSHIP STATUS DISCRIMINATION AGAINST MR 33. (b) (6) Complainant incorporates by reference the allegations set forth in paragraphs 1 through 32 above as if fully set forth herein. 34. Mr. (b) (6) was fully qualified to drive a tractor trailer truck when he applied fror employment with Respondent in January, 2002, and remains fully qualified today. 35. Respondent knowingly and intentionally discriminated against Mr. (b) (6) n the basis of his citizenship status by refusing to hire him because he is not a U.S. 5 citizen or permanent resident, and by rejecting his valid INS Forms 1-94 and I766. 36. Respondent's actions constitute an unfair immigration related employment practice in violation of 8 U.S.C. § 1324b(a)(1)(B) in that Respondent discriminated against Mr. (b) (6) with respect to hiring because of his citizenship status. 37. This illegal action directly and adversely affected Mr. (b) (6) COUNT II DOCUMENT ABUSE AGAINST MR. 38. (b) (6) Complainant incorporates by reference the allegations contained in paragraphs 1 through 37 as if fully set forth herein. 39. Mr. (b) (6) was fully qualified to drive a tractor trailer truck when he applied fror employment with Respondent in December, 2002, and remains fully qualified today. 40. Respondent demanded that Mr. (b) (6) produce a document issued by the INS for employment eligibility verification purposes under 8 U.S.C. § 1324a(b). 41. Respondent demanded a green card (INS Form 1-551 — resident alien card) after Mr. (b) (6) presented a valid INS Form I-688B (employment authorization document) for employment eligibility verification purposes under 8 U.S.C. § 1324a(b). 6 42. Respondent refused to hire Mr. (b) (6) because he was unable to present a resident alien card to establish his employment eligibility. 43. Respondent's actions constitute a request for more or different documents than required by 8 U.S.C. § 1324a(b) for the purpose of satisfying the requirements of such provision, and the rejection of valid documents, for the purpose or with the intent of discriminating against Mr. (b) (6) in violation of 8 U.S.C. § 1324b(a)(6). 44. This illegal action directly and adversely affected Mr(b) (6) COUNT III DOCUMENT ABUSE AGAINST MR 45. (b) (6) Complainant incorporates by reference the allegations contained in paragraphs 1 through 44 as if fully set forth herein. 46. Respondent demanded that Mr. (b) (6) produce a document issued by the INS for employment eligibility verification purposes under 8 U.S.C. § 1324a(b). 47. Respondent demanded that Mr. (b) (6) produce a green card (INS Form 1-551 resident alien card) after Mr. (b) (6) presented a valid INS Form 1-766 (employment authorization document). 48. Respondent's actions constitute a request for more or different documents than required by 8 U.S.C. § 1324a(b) for the purpose of satisfying the requirements of such provision, and the rejection of valid documents, for the purpose or with the intent of discriminating against Mr. (b) (6) 1324b(a)(6). 7 n violation of 8 U.S.C. § THEREFORE, Complainant respectfully requests: A. That the Office of the Chief Administrative Hearing Officer assign an Administrative Law Judge to preside at a hearing on this matter as soon as practicable; and B. That the Administrative Law Judge grant the following relief: 1. Order Respondent to cease and desist from the alleged illegal practices described in the Complaint; 2. Order Respondent to pay a civil penalty of $2,200 for citizenship status discrimination against Mr. 3. Order Respondent to pay a civil penalty of $1,100 for unfair documentary practices against Mr. 4. (b) (6) Order Respondent to pay a civil penalty of $1,100 for unfair documentary practices against Mr. 5. (b) (6) (b) (6) Order Respondent to educate its personnel concerning their responsibilities under 8 U.S.C. § 1324b; 6. Order Respondent to post notices to employees about their rights under 8 U.S.C. § 1324b, and Respondent's responsibilities under 8 U.S.C. § 1324a; 7. Order Respondent to make Mr. (b) (6) and Mr. (b) (6) whole with respect to all back pay and retroactive employee benefits and seniority lost as a result of Respondent's illegal actions, including interest; 8. I graduated December 22, 2001, and applied for a job with the Covenant Transport Company in Chattanooga, Tennessee. The person there in charge of hiring is (b) (6) old me to send her copies of the following documents: - passport - graduation diploma - Social Security - INS work authorization - references from previous jobs I Faxed copies of the documents to her, and later I received a package in the mail that contained, among other things, a letter saying I had been conditionally accepted to receive orientation classes. I called her to let her know I had received the package, and to ask when I should come in for the classes. That was January 15` h . She told me I could not work at Covenant Transport with the INS-issued permit, that I needed to have a green card to be able to work there. On January 18, 2002 I called the Justice Department, and they faxed me information about unfair employment practices. I sent a fax to Ms. (b) (6) opy of which I attach to this, containing the information I had received from the Justice Department. On the morning of February 22, 2002 (9:10am), Ms. (b) (6) called me, saying she was the manager of the human resources department. She apologized for what Ms. (b) (6) ad said to me, and said there had been a misunderstanding in the office that contracts drivers. She told me to fax her a copy of the letter I had received from Ms. (b) (6) as well as a copy of my passport, diploma, CDL driver's license, Social Security, etc., because she hadn't been able to Ind the file with my documents in it. She said that when she received the copies, she would call me that same afternoon, or the next morning. She gave me her phone number, her extension, and her fax number. She hasn't called back since. I called her back and left her a message on her answering machine, and up to the present I have had no further contact with her.
