Binational University to Create New Education Model BY ALEXANDRA MENDOZA on tending to the needs of low income individuals that have recently enrolled in some type of health insurance and have lacked habits such as frequent visits to their health care provider. Henry Tuttle, CEO of Health Center Partners, Spoke with La Prensa San Diego during the event. “As we are about to celebrate our 40th anniversary, our members have formed a new network that will seek to advance clinical and financial standards of care across our network of providers. we have 17 member organizations which currently operate 114 practice sites to care for about 760,000 patients with 2.5 million patient encounters every year in the three southernmost counties in California. We believe that we are better together in a clinically integrated network and higher standards for that patient population,: stated Tuttle. The creation of a binational university to be sited in Chula Vista was one of the projects presented at the 9th Border Committee Meeting of the San Diego Association of Governments (SANDAG). The proposal was moved forward by Chula Vista’s City Council in late January, and it is currently in the process of creating a Board and a foundation that would enable the project to fund construction. The idea behind the project is to have a campus that could host one or more universities from both countries and offer degree courses to students from both sides of the border. The City already has almost 400 acres of land for the project, just four miles north of the San Ysidro border. “The vision is to have a binational, bicultural, and bilingual campus… and acknowledge the workforce that sparks our region’s economy”, stated former Senator Denise Moreno Ducheny, who is part of the project’s advisory team. SANDAG members agreed that the project could serve as a model for higher education throughout the border region. “Successful projects could lead to and catalyze other, similar projects elsewhere along the border,” said Elisa Arias from SANDAG’s Planning Department. With an estimated 15,000 Mexican students enrolled in U.S. universities, it is essential for projects like this one to be promoted. “We know that many Baja California residents cross into the CONTINUED ON PAGE 3 CONTINUED ON PAGE 9 John Gómez: Una Entrevista con el Mejor Abogado de San Diego POR KATIA LÓPEZ-HODOYÁN Abogados hay muchos, pero en San Diego el Lic. PERSPECTIVE Rafael and Marco Antonio Sold Out On Immigration Reform A merica has been the dreamland for millions of immigrants from around world for over 200 years. The dream that has come true for so many can be illustrated in the stories of two fortunate immigrant families that fought hard to provide better lives for their children in America. One family came to the United States from Cuba in 1956 when Dictator Fulgencio Batista’s regime stifled the economy through corruption and misappropriation of national industries which caused economic hardship for middle class families. The family sought a better life in the US. The parents and their six-year old son settled in the heart of Miami, among Florida’s expat Cuban community. The father worked as a bartender and the mother as a hotel maid and stocker at a KMart store. They soon had another son, Marco Antonio, and later a daughter, both native born Americans. Their son, Mario Antonio, went on to graduate from the University of Florida and later earned a law degree from the University of Miami. He became a lawyer and later a professor at a local college. The other family has an even more interesting story. The father, Rafael, fled Cuba in 1957 after having been active as a teenager in the revolution to topple Batista. At age 18, his family bribed a Cuban official to let him leave the country. He fled with $100 sown into his underwear. He settled in Austin, Texas, and studied at the University of Texas, living on a student visa. After graduating, he got a good job in the oil industry and married an American woman named Eleanor Wilson. Rafael was granted political asylum when his 4-year student visa expired. They soon moved to Alberta, Canada, to launch a business supporting the oil industry. It was there that their son, Rafael Edward, was born. Rafael Sr. applied for and became a Canadian citizen. A few years later, the family relocated back to Texas where young Rafael excelled in school and eventually was accepted at the prestigious Princeton University. After graduating, he went on to earn a law degree from another elite university, Harvard, and became the first Latino to ever clerk for a Chief Justice of the Supreme Court. He later enjoyed a successful career as a lawyer. How can the stories of these sons of immigrant families get even better? Well, both young men went on to win elected offices and, eventually, both were elected to the most prestigious club in America: the United States Senate. Today, both of those ambitious young men in their mid-forties are vying to be the next leader of the free world as they compete for the Republican nomination for President of the United States. By now, you may have guessed that these are the stories of Rafael Edward (Ted) Cruz and Marco Antonio Rubio. Both their families immigrated to the US like so many of our families did. They sought better lives for themselves and their children. They believe that through hard work, they too could achieve the American dream. They had read the words of the Statue of Liberty: “Give me your poor, your tired, your huddled masses.” The beacon of freedom doesn’t call out for the rich, well-to-do, and affluent masses. It doesn’t ask what country they are from or their religion or the color of their skin. America has beckoned those hungry enough to want to be here to come seek a better life. The Cruz and Rubio families came here under a system that encouraged immigration in a country that welcomed them and ESPAÑOL P.1 PROFILE John Gomez: Meet San Diego’s Best Trial Lawyer 16 YEAR OLDS TO VOTE? U.S. Citizenship and Immigration Services is Moving Local Democratic Assemblywoman Lorena Gonzalez has introduced a constitutional amendment that would lower the voting age in the state to 16 years old for school board and community college elections. Gonzalez thinks 16 year olds have the same maturity and decision making ability as 18 year olds. Another bill Gonzalez voted for this week? A new law to raise the legal smoking age from 18 to 21. So 16 year olds are as smart as 18 year olds to vote but 18 year olds aren’t smart enough not to smoke? Maybe they should be raising BOTH to 21 and get better elected officials and less smokers. That has been the promise of this promised land. But lately, the politics of hate and division have taken over. The candidates for the Republican Party’s nomination have fought each other to see who is more anti-immigration, anti-immigrant, and, frankly, more anti-social. And leading that fight against immigration reform have been these two blessed and privileged sons of immigrants. Both Ted Cruz and Marco Rubio oppose meaningful immigration reform. They both argue about which one is more against a path to legal citizenship for millions that have fought to get here and have stayed to raise their families, just like the Rubio and Cruz families. It’s one thing to fundamentally disagree with a government policy and oppose it, but it’s completely hypocritical to benefit from it then oppose it for political gain. It’s time for both these firstgeneration American sons of immigrants to honor the promise of America and take a strong position for a comprehensive immigration reform package that is both humane and just. They owe it to this country that has given them so much. POR KATIA LÓPEZ-HODOYÁN When it comes to high profile attorneys, John Gomez tops the list. The San Diego native may have a laid back personality, but inside the courtroom it’s always game time. He has been named Trial Lawyer of the Year, both locally and nationally by U.S News and World Report. Judging from his track record, it’s easy to see why. His law firm, Gomez Trial Lawyers, boasts the best in the biz. It is hard work and long hours, but being an attorney seems more like a calling for Gomez, rather than just a job. “I have a responsibility to honor whatever gifts I have been blessed with,” said Gómez during a one on one sit down interview with La Prensa San Diego. “That responsibility goes way beyond making money.” Over the past ten years, his accident attorneys have collected over $350 million in verdicts and settlements. His wins are impressive, but the journey has not been easy. “When I was a kid, we moved around a lot,” says Gomez. “My mom was a single parent. She was poor and we would get evicted or we would move.” Growing up in a broken home led him from one school to the next. From Hilltop High School to Mt. Miguel and El Cajon Valley. He says he was much more interested in sports than studying. Even though academics wasn’t a priority at first, he transferred to Grossmont Community College. Then to the University of San Diego and eventually to Yale Law School, where he graduated in 1993. “Once I figured out that there was a path to success that I could control through my efforts, then it was very motivating. It continues to be a motivation.” That very motivation led him to work for a Fortune 500 company: Latham & Watkins and years later as a federal prosecutor for the U.S Attorneys Office, where he won 20 straight felony cases. But despite the success, he says something felt amiss. “I did not necessarily identify with a lack of leniency or of flexibility, especially with Mexican defendants who acted out of financial hardships,” says Gomez. “So I decided that I didn’t want to do that anymore. I wanted to work for the little guy, instead of the government or big companies.” He opened his San Diego law firm in September 2005 which now includes about 22 lawyers. The team is all business in the courtroom, but the atmosphere in his spacious downtown office is surprisingly relaxed. There’s a mock courtroom in the facility, which can be used by lawyers to train for a case or simply to teach kids about the legal process. His firm also has offices in Los Angeles, Solana Beach and Orange County. Looking back at his successful career, he says one local trial launched his national notoriety. Dubbed the ‘American Beauty Murder,’ Gomez led the case against Kristen Rossum. COVER STORY PG1 COMMUNITY CLINICS After unveiling the newly reformed association, Tuttle revealed two subsidiaries of Health Center Partners which will aid in meeting HCP’s goals The first subsidiary, Integrated Health Partners (IHP), is a network that brings together health centers throughout our communities with the aim of raising quality care standards and reducing the costs involved in . Integrated Health Partners leverages assembled data from nearly 500,000 patients to find the best solutions to the challenges that low income residents face, and to improve effective intervention in their medical care needs while tending to the shift to value based healthcare. IHP will also help boost improvements and quality of care, through rigorous assessments of performance and service quality which is a measure taken to continue success in the future. Integrated Health Partners will perform these duties while also acting as a single unified voice representing primary care providers in the network. A third subsidiary organization which will be joining these efforts was announced as well. Health Quality Partners (HPQ) will provide health outcome analyses through community action and programs to support clinics and health centers aiding the safety net population. HQP will make use of available resources and capital to bring services and programs that would otherwise not be available to community partner organizations. A wide range of programs such as disease management, behavioral health, oral health, women’s health and diagnostic services and more will be made available with high standards of attention and quality at partner clinics. With the advent of the affordable care act, many clinics in the community are moving from offering services to families to the senior demographic, a community which is often dealing with overlapping chronic conditions or illnesses that often go untreated or without regulation due to a lack to access to care. With a steady rise in member numbers, the launch of this networking effort feels timely. “Higher standards of care across our system is something to look forward to. Whether you seek care in Alpine, San Ysidro, El Cajon or Vista, our members will deliver the same standard of care from site to site. Patients will see improved clinical care over time because standards will be increased and made tougher every year,” Tuttle added. “As we forge the road ahead, we are focused on new strategic plans which will drive up support through 2020. Together we will serve as the nexus for our members and partners to transform our partners through innovation and collaboration. We will be the thought leaders and drivers of change in the marketplace,” Tuttle added. The San Diego Family Care Clinic, where the conference was held, is slated to open in six weeks in the Linda Vista area where thousands of community residents will be served. FREE at Petco Park www.lovestemsd.org MUSIC This is a race in memory of two local teenage girls, Chelsea King and Amber DuBois, who went missing right in our backyard in 2009 and 2010 respectively. This was a tragedy that hit too close to home and will be impossible to forget for the families of these two girls and the San Diego community. The King family managed to bring something positive out of this irreparable loss and managed to bring forth stricter laws against sexual predators (Chelsea’s Law) and the Sunflower Scholarship Fund which benefits outstanding students. We can only hope that our community never has to bear the loss of any of our children to such tragedy ever again. If you are free this Saturday, be sure to stop by and support the King Family and finish what should have been a routine run for Chelsea before her life was taken six years ago. Here is a message from the family: “When our daughter Chelsea went missing, and we learned the terrible truth of our loss, we struggled to find air to breathe. Today, we are able to see with such clarity the people that provided us our oxygen during our crisis. It’s because of your response to our crisis that we were able to find the strength to choose hope. It’s because of your engagement that our state now has the strongest laws in the Country protecting our 9.3 million California children from known violent predators and we are expanding to other states. It’s because of your support that we are able to recognize and honor phenomenal young changemakers with college scholarships. According to the hundreds of border-crossers who say they have been mistaken for criminals, in spite of the cutting-edge technology, Customs and Border Protection agents can still make mistakes. Which has lead to what these travellers assure has been one of the worst times of their lives. “They took me out, cuffed me, and took my car away for inspection without saying so much as a word. I was taken to a detention cell, left there for a couple of hours, had my fingerprints taken, my ID checked, the whole process. And, when it’s all said and done, it turns out that I’m not the person they were looking for,” said Jorge Garcia, a U.S. citizen living in San Diego who was victimized by CBP agents, to La Prensa San Diego. “In fact, I have three friends who have my same name and the same thing has happened to them,” assured Garcia. “They abuse their authority, and they don’t treat you the way they should: like a person, like a human being. I am one of those people who will speak out; In fact, my husband is always warning me ‘they’re going to take away your Visa,’ but the worst-case scenario is just having it taken away, because we have rights, and the more we don’t say anything the more abusive they can be,” stated Cecilia Zavala, who crosses into the U.S. almost every day. People are left with a feeling of anger, rage, powerlessness, and above all a deep humiliation after being treated in what they consider such a demeaning way. In response to the treatment, a Tijuana-San Diego NGO has launched a program to protect these travelers’ human rights. “The Southern Border Communities Coalition has a program that consists of a phone number people can call if they feel their rights were violated at a port of entry. We have seen how Border Patrol and Port of Entry officers can use their power in violation of human values. Since CBP is unwilling to provide data, we have to collect it. We need people to not remain quiet when they are treated disrespectfully by border agents,” explained ACLU spokesperson Ana Castro. Mexican authorities have expressed that, just like Tijuana police officers have been provided sensitivity training and other courses to better serve foreign visitors, the U.S. should take similar measures in light of the huge number of complaints they receive from border crossers. In November 2000, she was convicted of murdering her spouse with a lethal dose of fentanyl. Rossum stole the narcotic from the San Diego County Medical Examiner’s office where she worked. Gomez won the trial against the defendant, but most importantly against the County for hiring Rossum, a former drug addict. A whopping $106 million were awarded to the victim’s family in punitive damages. Gomez also led the so called ‘Runaway Lexus’ case, which resulted in the deaths of CHP officer Mark Saylor, 45, his wife, daughter and brother in law. Toyota Motor agreed to pay $10 million to the victims’ family. The settlement was followed by a massive recall. But with so much success, also comes responsibility. That includes a conscious effort of staying humble. More than just a ‘feel good’ mantra, Gomez says staying in check, is also a practical tool in the courtroom. “There is always the possibility or threat of arrogance deceiving trial lawyers because they’re kind of running the show. They might think they’re the big shot, but a good trial lawyer has to be genuinely humble because arrogance can turn off jurors.” Gomez is obviously good at what he does, but every now and then a bit of superstition creeps in. He has a set of non written rules he always follows when on trial. First, he always gives money to the DESCUBIERTAS RACISMO EN EUA en temas deportivos”, indicaron ejecutivos de la empresa. In addition to being an active member of the Rock Church, giving back to the community is also a main priority of his. His troubled past, he says, makes it ever more important to support underprivileged kids. Some of John’s charity work includes the Community Youth Athletic Center in National City. The staff in the boxing gym usually works with high risk youths from the South Bay, Barrio Logan and Shelltown. “For parents who don’t have a lot of money and who want to get their kids in a positive environment, this is the place,” says Gomez. “It’s great. It can also help overweight kids who have issues with self esteem and dieting.” When it comes to low profile cases, Gomez recognizes that reaching out to lawyers is a problem for many undocumented families. The fear of being turned over to immigration authorities, often trumps their desire for justice. “The law is intended to provide equal protection for everyone. That can only happen if people who suffer harm, discrimination or unjust treatment, find someone who can stick up for them,” he says. “Regardless of who you are, if you are in this country you should not suffer treatment that is illegal or unjust.” So what’s next for one of the best trial lawyers in San Diego? Gomez says he is not interested in being a judge or running for office. For now, he says it’s all about “my contributions to my church, staying healthy, being a great leader of a law firm and being a great dad.” They are called ‘Las Patronas,’ which makes reference to the name of the town they live in. Every day, they help hundreds of complete strangers who pass by on a freight train, known as ‘La Bestia’ or ‘The Beast.’ They don’t know these people’s names, age or nationality. The only thing they know is that the Central American migrants are passing through Mexico and heading north, hoping to make it to the U.S. Their interaction lasts only a few seconds: They lock eyes. The migrants stretch out their arms from the moving train and Las Patronas, almost instinctively, start tossing bottles of water and bags filled with rice, beans and tortillas. There’s no conversation, but the entire exchange speaks volumes. A film titled “All of Me,” delves into the lives of these women, showing how despite being uneducated, poor and marginalized, they are also strong, devoted and inspiring. The University of San Diego’s Trans-Border Institute invited the film’s producer and one of the Patronas on campus, for a screening of the film and lecture on February 25th. “It started off as something small,” says Mariela Najero Romero, one of the roughly 14 Patronas who make up the group. “It really came out of nowhere, but now it has become something big.” It was back in 1995, when one of the founders, Norma Romero Vasquez, says migrants walking through the railway tracks asked her for food. She helped and eventually reached out to her family and neighbors, young and old, to chip in. Years passed, and as the number of migrants grew, so did the contributions of Las Patronas. Despite their own economic hardships, the group continues to prepare warm meals for the migrants day in and day out. They cook for hours and wait patiently for the train to pass, while still wearing an apron. Twenty one years later, Las Patronas have won awards and garnered international attention for their voluntary work. They do everything for free. Their only compensation is knowing they are helping those in need. “I understand there are good and bad people on that train,” says Romero as she speaks at USD. “But it’s not my place to judge them. That’s up to God.” While governments and politicians highlight all the problems with the immigration system, Las Patronas focus on the basics. Their mission is not about politics or even diplomacy. On the contrary, they simply see hungry people and feed them. When migrants fall off the train and can’t manage to get back on, Las Patronas offer them a place to stay, until they try their luck again and head north. When migrants get injured, they find medical assistance and care for them as best they can. But there have been doubts along the way. There came a point when Las Patronas didn’t know if helping these migrants, mostly from El Salvador and Honduras, was legal in Mexico. They wanted to help, but they didn’t want to get in trouble doing so. “We were afraid,” says Romero. “We didn’t know what was legal and what wasn’t. There were groups who were trying to intimidate us. We got informed. Turns out, we do have the right to help them.” The issue of abuse has also been an issue. Mexico has a reputation for not always being welcoming to Central American migrants, even if their intention is to simply pass through the country. Patronas have witnessed cases where immigration officials have abused their authority by targeting Central American migrants. It can range from insults to stealing money and even violence. “When we started asking questions,” explains Romero, “We learned that the local police does have the power to conduct raids and detain the migrants. But what they cannot do, is abuse their power.” So as the train continues to pass through the town, Las Patronas continue to feed those on board. The train, The Beast as it’s called, has turned into a symbol of sorts. It’s moving forward, but it also leaves people behind. It can lead migrants to a better life, but it can also kill them. Ironically, the film shows how some of the women who help these migrants heading north, also have their own hopes of maybe one day making the same journey to the U.S. The film shows a young Patrona crying, as she explains that there are virtually no opportunities or jobs in her town. At least, up north, she cries, she and her kids can have a better future. Money is tight, but they’ve never stopped giving out meals. A few non-profits and Mexican universities have chipped in with donations so the group can continue to feed passing migrants. Over the years they’ve fed thousands of perfect strangers. Every now and then, they get a phone call from some of the migrants who made it successfully to the U.S. They just call to say ‘thank you.’
