STATEMENT OF CONCERN
IN SUPPORT OF AMICUS CURIAE BRIEF TO
THE NEW MEXICO SUPREME COURT
We, the undersigned, are medical doctors practicing in or near El Paso, Texas. Prior to learning about the Montaño decision we
proceeded with the understanding that if we as Texas residents elected to provide medical care in Texas to patients voluntarily
choosing to leave New Mexico and seek medical treatment in Texas then Texas law would cover any claim arising out of the
care we provide in Texas. If the Montaño appellate court decision stands, then liability concerns will play a more prominent
role in the decision of Texas providers to see New Mexico residents for elective care and may impact the willingness of Texas
doctors to continue to accept New Mexico patients on an elective basis. It may also disrupt the time-honored practice of New
Mexico physicians referring their patients to Texas for elective treatment in that Texas providers may be less willing to accept
those patients.
